(1) These are the official rules ("Rules) for the SurfReel "Global Event" Competition (the "Promotion"). If you participate in the Promotion, you ("Entrant") agree to comply with and be bound by the Rules.
(2) The Promotion is void where any aspect of the Promotion is prohibited by law or where registration, bonding or translation is required.
(3) The SurfReel Global Event annual competition begins September 1 and concludes August 31 yearly unless otherwise specified. Monthly competitions commence at 12 a.m. on the first day of every month, and conclude at 12 a.m. on the final day of each month.
(4) Entrant must supply a valid email address as part of the registration process and other identification information as requested.
(5) Identification which includes a photograph will be required (examples include drivers license/passport/student card where photo is included) when claiming and collecting their prize.
(6) Winners under the age of 18 must supply parental or guardian identification and letter of consent when claiming and collecting their prize.
(7) Entries are limited to one (1) monthly reel (video) entry per user. Persons are limited to one (1) SurfReel account.
(8) Each entry must be no more than 15 megabytes in size.
(9) Each entry must be "in good taste", may not contain any sexually explicit material or illegal content or activity, and must otherwise comply with SurfReel’s terms.
(10) It is the winner's responsibility to collect their prize. No cartage expenses are included in the prizes.
(11) The user and judge’s decisions are final and cannot be contested. No correspondence will be entered into.
(12) Employees, independent contractors, officers, and directors of NastyGoat Corporation, its affiliates, subsidiaries, partners, advertising, promotion, and fulfillment agencies, and legal advisors, the judges, and the immediate family members and persons living in the same household of such persons, are not eligible to win a prize in the Promotion.
(13) Each Entrant warrants that (1) materials included in any entry are original with the Entrant (or that the Entrant has the right to submit such materials), (2) any person depicted in an entry is able to give, and has given, his/her full consent to participation and to the exploitation of the rights in the entry envisaged hereunder, (3) any music included in the entry is cleared for use as envisaged hereunder, and no further release needs to be obtained by SurfReel or any third party in relation to such exploitation, (4) the materials within the entry do not contain information considered by Entrant's place of business or any other third party to be confidential, and (5) the entry and all included materials do not violate or infringe the rights of any third parties or violate any laws or regulations.
(14) The Promoter shall not be liable for any loss or damage whatsoever which is suffered (including but not limited to indirect or consequential loss) of for personal injury which is suffered or sustained, as a result of taking any of the prizes, except for any liability which cannot be excluded by law. It is a condition of accepting the prize that the winner may be required to sign a legal release in a form determined by the Sponsor and/or SurfReel in its absolute discretion.
(15) Judging to determine the monthly winners among the competition entries will be conducted by SurfReel registered users . Judging to determine the SurfReel Global Event winners among the monthly competition winners will be conducted by SurfReel judges or its designee(s). This is for all presentation awards (Purse Prizes). SurfReel will judge the competition entries based on three equally weighted factors: (i) creativity; (ii) application of competition theme; and (iii) surfing skill. Because this part of the Promotion is a contest of skill, winning the contest aspect of the promotion is dependent on the quality of submissions received. The odds of winning will also depend upon the number of entrants received.
(16) SurfReel will award: (1) one cash prize for first place for each demographic category (Men, Women, Grom, Gromlett) for the Annual SurfReel Global Event Competition: 50% of SurfReel net advertising earnings ALL TAXES ASSOCIATED WITH THE RECEIPT OR USE OF THE PRIZES ARE THE SOLE RESPONSIBILITY OF THE WINNERS.
(17) Winners will be announced 60 days after the conclusion of each annual Global Event competition. Each winner will be notified by email within 10 days after selection. Notifications and prize will be sent to the winner's email address of record. If the notification or the prize cannot be delivered to such address, the prize may be forfeited and an alternative winner may be selected. All decisions by SurfReel are final and binding in all matters relating to this Promotion.
(18) Purse winnings will be paid to competition winner in part or full in the method of SurfReel’s choosing. In the event SurfReel deems the money transfer to be illegal or not secure, SurfReel reserves the right to withhold or refuse transfer of winnings.
(19) The winners may at the absolute discretion of NastyGoat Corporation be required to execute a Deed of Release and Indemnity in a form prescribed by NastyGoat Corporation in order to receive the major prize. If a winner is under the age of 18, their parent/guardian may, at the absolute discretion of NastyGoat Corporation be required to sign the Deed of Release and Indemnity.
(20) Entrant, by submitting information and/or video, hereby grants SurfReel the right to display such on the Site both during and following the term of the Promotion, and acknowledges that the submissions may be accessed, downloaded and used by visitors to the Site pursuant to the published Terms of Use for the Site.
(21) ENTRANT RELEASES AND AGREES TO INDEMNIFY AND HOLD HARMLESS NASTYGOAT CORPORATION AND ITS AFFILIATES, DIRECTORS, OFFICERS, EMPLOYEES, PARTNERS AND AGENTS FROM ANY LIABILITY WHATSOEVER FOR ANY CLAIMS, COSTS, LOSSES, OR DAMAGES (INCLUDING INFRINGEMENT OF PROPRIETARY RIGHTS, RIGHTS OF PUBLICITY OR PRIVACY OR DEFAMATION) ARISING OUT OF OR IN CONNECTION WITH: (I) THE ENTRY SUBMITTED BY ENTRANT; (II) ENTERING AND PARTICIPATING IN THE PROMOTION; AND/OR (III) ACCEPTING OR USING ANY PRIZE. HOWEVER NOTHING IN THESE RULES SHALL LIMIT SPONSOR'S LIABILITY UNDER ANY CATEGORY OF LIABILITY WHICH UNDER THE LAW OF AN ENTRANT'S JURISDICTION CANNOT LAWFULLY BE LIMITED.
(22) NASTYGOAT CORPORATION RESERVES THE RIGHT TO REVISE AND/OR CANCEL ANY AND ALL COMPETITION TERMS OF USE AND CONDITIONS AT ANY TIME RETROACTIVELY.
(23) Prize money will be paid in US Dollars.

B. In order to access some features of the Website, you will have to create an account. You may never use another's account without permission. When creating your account, you must provide accurate and complete information. Content on the Website is provided to you AS IS for your information and personal use only and may not be used, copied, reproduced,distributed, transmitted, broadcast, displayed, sold, licensed, or otherwise exploited for any other purposes whatsoever without the prior written consent of the respective owners. “SurfReel” reserves all rights not expressly granted in and to the Website and the Content.You agree to not engage in the use, copying, or distribution of any of the Content other than expressly permitted herein, including any use, copying, or distribution of User Submissions of third parties obtained through the Website for any commercial purposes. 5. User Submissions
A. The “SurfReel” Website may now or in the future permit the submission of videos or other communications submitted by you and other users ("User Submissions") and the hosting, sharing, and/or publishing of such User Submissions. You understand that whether or not such User Submissions are published, “SurfReel” does not guarantee any confidentiality with respect to any submissions.
B. You shall be solely responsible for your own User Submissions and the consequences of posting or publishing them. In connection with User Submissions, you affirm, represent, and/or warrant that: (i) you own or have the necessary licenses, rights, consents, and permissions to use and authorize “SurfReel” to use all patent, trademark, trade secret, copyright or other proprietary rights in and to any and all User Submissions to enable inclusion and use of the User Submissions in the manner contemplated by the Website and these Terms of Service; and (ii) you have the written consent, release, and/or permission of each and every identifiable individual person in the User Submission to use the name or likeness of each and every such identifiable individual person to enable inclusion and use of the User Submissions in the manner contemplated by the Website and these Terms of Service. However, by submitting the User Submissions to “SurfReel” , you hereby grant “SurfReel” a worldwide, non-exclusive, royalty-free, sublicenseable and transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform the User Submissions in connection with the “SurfReel” Website and “SurfReel” 's (and its successor's) business, including without limitation for promoting and redistributing part or all of the “SurfReel” Website (and derivative works thereof) in any media formats and through any media channels. You also hereby grant each user of the “SurfReel” Website a non-exclusive license to access your User Submissions through the Website, and to use, reproduce, distribute, prepare derivative works of, display and perform such User Submissions as permitted through the functionality of the Website and under these Terms of Service. The foregoing license granted by you terminates once you remove or delete a User Submission from the “SurfReel” Website.
C. 8. Indemnity
You agree to defend, indemnify and hold harmless “SurfReel” , its parent corporation (NastyGoat Corporation), officers, directors, employees and agents, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees) arising from: (i) your use of and access to the “SurfReel” Website; (ii) your violation of any term of these Terms of Service; (iii) your violation of any third party right, including without limitation any copyright, property, or privacy right; or (iv) any claim that one of your User Submissions caused damage to a third party. This defense and indemnification obligation will survive these Terms of Service and your use of the “SurfReel” Website.
9. Ability to Accept Terms of Service
You affirm that you are either more than 18 years of age, or an emancipated minor, or posses legal parental or guardian consent, and are fully able and competent to enter into the terms, conditions, obligations, affirmations, representations, and warranties set forth in these Terms of Service, and to abide by and comply with these Terms of Service. In any case, you affirm that you are over the age of 13, as the “SurfReel” Website is not intended for children under 13. 10. Assignment
These Terms of Service, and any rights and licenses granted hereunder, may not be transferred or assigned by you, but may be assigned by “SurfReel” without restriction.

You agree that: (i) the “SurfReel” Website shall be deemed solely based in Texas; and (ii) the “SurfReel” Website shall be deemed a passive website that does not give rise to personal jurisdiction over “SurfReel” , either specific or general, in jurisdictions other than Texas. These Terms of Service shall be governed by the internal substantive laws of the State of Texas, without respect to its conflict of laws principles. Your use of the “SurfReel” Website and/or signature, and following any amendment of these Terms of Service will signify your assent to and acceptance of its revised terms. YOU AND “SURFREEL” AGREE THAT ANY CAUSE OF ACTION ARISING OUT OF OR RELATED TO THE “SURFREEL” WEBSITE MUST COMMENCE WITHIN ONE (1) YEAR AFTER THE CAUSE OF ACTION ACCRUES. (3) The competition commences at 8am on Sunday, 26 August 2007 and concludes at 11.00am.
(8) Identification which includes a photograph will be required (examples include drivers licence/passport/student card where photo included) when claiming and collecting their prize.
(9) Winners under the age of 18 must be accompanied by a parent or guardian when claiming and collecting their prize.
(16) It is the winner's responsibility to collect their prize. No cartage expenses are included in the prizes.
(17) The judge’s decision is final and cannot be contested. No correspondence will be entered into.
(18) The Promoter shall not be liable for any loss or damage whatsoever which is suffered (including but not limited to indirect or consequential loss) of for personal injury which is suffered or sustained, as a result of taking any of the prizes, except for any liability which cannot be excluded by law. It is a condition of accepting the prize that the winner may be required to sign a legal release in a form determined by the Promoter in its absolute discretion.
(19) The winner of any competition may at the absolute discretion of SurfReel.com be required to execute a Deed of Release and Indemnity in a form prescribed by SurfReel.com in order to receive the major prize. If a winner is under the age of 18, their parent/guardian may, at the absolute discretion of SurfReel.com, be required to sign the Deed of Release and Indemnity.
